Natural versus Unnatural Snow and Ice Accumulation

Business owners, property managers, and homeowner may be liable for your injuries if they did not properly clear snow or ice. Massachusetts premises liability law allows recovery if an unnatural accumulation of snow or unnatural accumulation of ice caused the slip or fall. Natural snow or ice accumulation, however, is not enough for a claim of homeowner negligence. Examples of unnatural accumulation of snow or ice include:

  • A leaky drain
  • A partially shoveled driveway or sidewalk
  • Poorly shoveled driveway
  • Piles of unnatural snow or ice

If the negligence of an owner - home or business - created an area of snow or ice that should not have otherwise been there, they may be liable for your injuries. Our staff is skilled at evaluating the facts of your negligence claim to determine whether you have a slip and fall claim. We know how to maximize compensation for your injuries. If an owner was negligent in clearing snow or ice, you can get damages for medical bills, lost wages, and temporary or permanent disability.

Representative Case
A 59 year old married software engineer from Carlisle sustained a severe ankle fracture when he slipped and fell on ice on a walkway at a gas station; the ice formed on the pavement underneath a leak in the gutter above the sidewalk. His ankle fracture (distal fibula fracture with widened ankle mortise and deep deltoid avulsion fracture) required an ORIF (Open Reduction Internal Fixation) surgical procedure. Physical therapy followed and about 18 months later, he underwent another surgical procedure for removal of the hardware. There was minimal lost time from work, but his medical bills were approximately $33,000.00. One day before Binding Arbitration, the case was settled for $120,000.00. Third Party Liability Claims Against the City or State Need a Quick Response

By statute, an ice or snow slip and fall injury claim against a town or city is limited to $5,000, regardless of your losses. There is also a notice requirement for bringing suit. However, this should not deter you from calling Kelley and Trehub. There may be an additional claim against a private contractor, homeowner or other third party not bound by a limit on damages.
